The United Kingdom’s efforts to combat climate change have taken a blow after the High Court declared that the Carbon Budget Delivery Plan (“CBDP”) was unlawful. The court ruled that the plan lacked crucial details that would indicate how the country intended to achieve its targets of curbing emissions linked to global warming.
The court pointed out that the details of this plan were “unquantified and vague.” This absence of clarity meant it would be nearly impossible to ascertain whether the UK could realistically attain the stated goals of reducing emissions so that the milestones for 2030 and 2050 are met.
Furthermore, the court took issue with the assumption that every policy action in the impugned action plan would fully attain its set objectives. The plan didn’t have any contingency measures to address potential pitfalls within the plan or have viable “risk tables” simulating the degrees of success that would be attained under different scenarios for the policies set.
The decision of the High Court has several potential ramifications. The government now has the task of creating an improved version of the plan within a year. This new version must be clear on how the UK will meet its targets to reduce emissions in light of the budgets available.
Several environmental groups, including Client Earth, expressed their dissatisfaction with the way the government was handling matters of climate change. They are now calling for a robust plan to be made in light of the scathing ruling made by the High Court. The opposition has also jumped on this opportunity to criticize the government. The government is now under pressure to create a “lawful” and “credible” plan to address climate change.
While the country’s department of energy security downplayed the ruling of the court saying that the focus was on “procedural” rather than “detailed plans,” the onus is now on those in government to respond by coming up with a concrete and effective plan to address the concerns raised by the court. Otherwise, political opponents can use that as fodder to discredit the government.
The government now has a chance to bridge the gap between its stated climate action objectives and the practical measures that it intends to take in order to attain those objectives within the timelines set out in its targets. How they take on this challenge will determine whether the UK stays on course to reach its climate goals or falls by the wayside.
